1. Acceptance of Terms

These Terms of Service ("Terms") form a binding legal agreement between you ("you" or "user") and Mold Restoration Pros #1, LLC, a Florida limited liability company doing business as "Mold Restoration Pros" ("Company," "we," "us," or "our"), governing your access to and use of the website at https://moldrestorationpros.com/ (the "Site") and any related services, including scheduling, estimating, and our AI-assisted mold identification tool (collectively, the "Services"). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

2. Description of Services

The Company provides mold inspection, testing, remediation, and restoration services to residential and commercial customers, along with an informational, AI-assisted photo analysis tool intended to provide a preliminary indication of possible mold presence. Actual restoration and remediation services are provided under a separate service agreement or estimate for the specific property and scope of work.

3. Eligibility

You must be at least 18 years old and have the legal authority to request services for the property in question (as an owner, tenant, or authorized representative) to use the Services.

4. Acceptable Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Upload content that is false, misleading, infringing, defamatory, or that you do not have the right to share;
• Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Site, our systems, or the AI tool;
• Use automated means (bots, scrapers) to access the Site without our written permission;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Introduce viruses, malware, or other harmful code.

5. Scheduling & Service Appointments

Requests submitted through the Site for inspections, estimates, or restoration services are subject to availability and confirmation by our team. We will contact you by phone, email, or SMS text message (in accordance with our SMS / Messaging Terms) to confirm, reschedule, or provide updates about appointments. Providing accurate contact and property information helps us serve you promptly; inaccurate information may delay or prevent service.

6. AI Mold Identification Tool

The AI-assisted photo analysis tool available on the Site is provided for general informational purposes only. It analyzes user-submitted photographs to produce a preliminary, automated estimate and does not constitute a certified mold inspection, laboratory test result, or professional diagnosis. Full terms governing the AI tool, including important limitations, are set out in our AI Disclaimer & Limitation of Liability, which is incorporated into these Terms by reference.

7. Pricing, Payment & Cancellation

Pricing for inspection, testing, and restoration services will be provided in a written estimate or invoice prior to performance of work, unless otherwise agreed. Payment terms, accepted payment methods, deposit requirements, and cancellation or rescheduling policies will be set out in your service agreement or invoice. Late payments may be subject to additional fees as permitted by law.

8. Intellectual Property

The Site and its content, including text, graphics, logos, the "Mold Restoration Pros" name and marks, software, and the design and output formatting of the AI tool, are owned by or licensed to the Company and are protected by copyright, trademark, and other intellectual property laws. Except as necessary to use the Services for their intended purpose, you may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

9. User-Submitted Content

By uploading photographs, descriptions, or other content to the Site (including for AI-assisted analysis), you represent that you own or have the right to share that content, and you grant the Company a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process that content solely to provide, support, and improve the Services. 10. Third-Party Links & Services

The Site may reference or link to third-party websites, payment processors, scheduling platforms, or messaging providers that are not owned or controlled by the Company. We are not responsible for the content, policies, or practices of any third party.

11. Disclaimers

THE SITE, SERVICES, AND AI TOOL ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITE OR AI TOOL WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Additional disclaimers specific to the AI mold identification tool are set out in our AI Disclaimer & Limitation of Liability.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS OWNERS, OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE (AS DISTINCT FROM A SEPARATELY CONTRACTED RESTORATION SERVICE, WHICH IS GOVERNED BY ITS OWN SERVICE AGREEMENT) SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction of those courts.

15. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Company, other users, or third parties.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the documents referenced herein (including the Privacy Policy, AI Disclaimer & Limitation of Liability, Cookie & Tracking Policy, and SMS / Messaging Terms), constitute the entire agreement between you and the Company regarding the Site, and supersede any prior agreements regarding the Site. A separate written service agreement governs any restoration or remediation work performed at your property.

17. Changes to These Terms

We may revise these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
